Can employer B use employer A's I-140 and file the extension beyond max cap (6 years) ?

Recommended Posts

I joined Employer A , and I have Approved I-140 from "employer A", After that i moved to "employer B",
and employer B is not willing to file PERM & port my i-140,i will be completing my Max out(6 years) by Dec 2020,

Recently, Employer B got project extension until Dec 2021 , so he would like to use employer A's I-140 and file my H1 extension for 1 extra year period beyond max cap period(i.e. until Dec 2021)
Question:
Can employer B use employer A's I-140 and file the extension beyond max cap (6 years) ?
Any inputs/suggestions are appreciated... thank you

Yes, any employer can use the 140 to file an Extension, it is not required to be from the same employer.
