Are you considering an H1B transfer to a new employer? Wondering about the time frame and important aspects to consider during the process? This video provides comprehensive information and guidelines regarding the time frame for an H1B transfer.
Immigration Attorney Prashanth Dubey explains the process; if you need help with your Immigration Case, please email him at info@dubeylawoffice.com
The H1B transfer time frame varies depending on factors such as USCIS processing times, current workload, and possible delays. Generally, an H1B transfer can take a few weeks to a few months. However, it’s important to note that each case is unique, and individual circumstances might impact the overall duration.
Understanding the time frame for an H1B transfer is crucial for employers and employees. It helps in planning the transition effectively, ensuring minimal disruptions to work and legal compliance. Stay informed and make well-informed decisions by watching this informative video.
• Regular Processing: The time frame can vary significantly under regular processing. As of my last update, it could take anywhere from a few months to more than six months. The exact time depends on the workload and processing times at the USCIS service center handling the case.
• Premium Processing: The processing time is significantly reduced if the employer opts for premium processing, which involves an additional fee. USCIS aims to process these petitions within 15 calendar days. This expedited service is often preferred for its predictability and speed.
Factors Influencing Time Frame:
• Service Center Workload: Different USCIS service centers may have varying processing times based on their workload.
• Completeness and Accuracy of Application: Delays can occur if there are issues with the petition, such as missing documents or the need for additional information (Request for Evidence).
• Immigration Policy Changes: Processing times can be affected by changes in immigration policies or procedures.
• After Submission: Once the H1B transfer petition is submitted, you can start working with the new employer upon receipt of notice from USCIS, based on the H1B portability rules, as long as you were in lawful H1B status at the time of filing and the new job is in the same or similar occupational classification.
